Wisconsin Orders Back Pay, Seeks $828,000 Penalty Over 1,656 Child Labor and Wage Violations at Burger King Franchisee

The labor department set a 20-day deadline before sending the case to state prosecutors.

Overview

  • Cave Enterprises must pay $237,437.29 in unpaid regular, overtime, and penalty wages to affected workers under the state’s determination.
  • Regulators reported violations at about 103 of 105 Burger King locations, affecting more than 600 minors across Wisconsin.
  • The audit found 593 workers ages 14–15 started without required permits and 627 minors worked six or more hours without a 30-minute meal break.
  • Investigators also cited hundreds of under‑16 workers for illegal hours and 67 instances where 16–17‑year‑olds were denied required overtime for 10‑hour shifts.
  • The review covered Jan. 1, 2023, to Jan. 25, 2025, followed 33 prior complaints since 2020, and carries proposed fines up to $500 per violation; if unpaid, the DOJ could pursue enforcement and a court could set final penalties.
