Waltham Man Charged With Manslaughter in Deadly Gas-Station Confrontation

Investigators say surveillance helped identify the suspect and they are seeking public dashcam footage to clarify events before an arraignment.

  • A confrontation in the entryway of Woodside’s Service Center on May 27 left 23-year-old Nicholas Dagostino injured and confused before he was taken to a hospital.
  • Dagostino suffered a brain bleed and a small skull fracture and died at Lahey Hospital on May 29 after doctors tried to treat his injuries.
  • On June 8 prosecutors charged 31-year-old Timothy Scalisi with manslaughter and assault and battery causing serious bodily injury and scheduled an arraignment in Waltham District Court.
  • Police say they identified and located Scalisi using surveillance from the gas station, nearby businesses and Flock traffic cameras and are asking drivers to check dashcam footage from about 8:40–8:50 a.m. on May 27.
  • Prosecutors allege Scalisi picked Dagostino up and violently threw him to the ground during an argument over blocking the gas-station entrance and investigators say the men did not appear to know each other, a detail that raises public safety concerns for morning rush-hour traffic.
