VW Dealers File Class Action as Scout Motors Doubles Down on Direct Sales

The case tests whether a VW-linked startup can bypass franchise rules under direct-sales exemptions.

Overview

  • Two Volkswagen dealers from New York and Connecticut filed a federal class-action in Virginia alleging Scout is a VW offshoot using direct online sales in breach of dealer agreements, and they seek to represent VW dealers nationwide.
  • Scout CEO Scott Keogh reaffirmed the company’s direct-to-consumer strategy, saying reservations will continue online with plans for company-owned stores, and the company maintains it operates independently of Volkswagen’s dealer network.
  • Separate dealer actions in Colorado, California and Florida challenge Scout’s sales model and question eligibility for EV-only carve-outs because Scout plans extended-range electric variants with gasoline generators.
  • Scout says it has roughly 160,000 reservations for the Terra pickup and Traveler SUV, with a large majority—reported at about 80% to 87%—opting for the extended-range electric configuration over the battery-electric version.
  • Keogh told Motor Trend the Terra’s maximum towing drops from over 10,000 pounds to about 5,000 when equipped with the gasoline range extender, a trade-off that adds range but reduces capability.
