Voyager Investors Appeal Dismissal of Suit Against Mark Cuban and Mavericks

The Eleventh Circuit will decide whether the case can return for merits litigation or require investors to seek a new venue.

Overview

  • Plaintiffs filed a notice of appeal on June 23, 2026 asking the U.S. Court of Appeals for the Eleventh Circuit to review the December 2025 dismissal and a later order denying a reopening or transfer.
  • The December 2025 dismissal was procedural only and found that the Florida court lacked personal jurisdiction over Cuban and the Texas-based Mavericks rather than ruling on the fraud or securities claims.
  • The suit alleges Cuban endorsed Voyager at a October 27, 2021 Mavericks press conference and that a Mavericks sponsorship and a $100 Bitcoin promotion helped drive retail customers to the platform.
  • Three celebrity defendants settled in 2024 for a combined $2.4 million and exited the case, and the plaintiffs are now led by high-profile lawyers David Boies and Adam Moskowitz.
  • If the appeals court reverses the dismissal the case would return to district court for merits discovery and trial while an affirmance would likely force plaintiffs to refile elsewhere or abandon claims and shape future promoter-liability tests.
