Valencian High Court Registers Bid To Investigate Mazón Over 2024 Flood Response

Magistrates will decide after a short submissions period whether to take up the case set out in the trial judge’s exposición razonada.

Overview

  • The Tribunal Superior de Justicia de la Comunidad Valenciana has registered Judge Nuria Ruiz Tobarra’s request to investigate former regional president Carlos Mazón for alleged gross negligence tied to the October 29, 2024 DANA that left 230 dead.
  • The panel assigned to rule on admitting the request comprises Manuel Baeza, Pía Calderón as reporting judge, and José Francisco Ceres, with a two-day window for parties to file arguments, according to the court.
  • Ruiz Tobarra has rejected efforts to recuse her and to void the proceedings, labeling the filings by lawyer Rubén Gisbert a procedural fraud and noting the criminal complaint against her has not been admitted.
  • The instruction continues with new evidence steps, including a request to the Emergency Coordination Center for logs of calls to municipalities during the hydrological alerts on October 29, 2024, and invitations for parties to state their positions.
  • At this stage the case formally investigates former consellera Salomé Pradas and ex–number two Emilio Argüeso, and because Mazón is an aforado deputy any probe of him can only be conducted by the TSJCV; the judge notes the Audiencia Provincial has largely upheld her key rulings.
