- On Thursday, Aug. 13, USCIS announced an automatic extension of employment authorization through Sept. 9, 2026 for Salvadoran TPS beneficiaries with pending I-765 renewal requests whose EADs are in categories A-12 or C-19.
- Affected workers will receive notice by postal mail or through myUSCIS and must present their expired EAD together with the USCIS notice as List A evidence for Form I-9.
- Employers are instructed to record “Sept. 9 2026” as the employee’s work-authorized expiration date on Form I-9 and to enter the same date in E-Verify while retaining the official USCIS notice in their records.
- For Somali TPS beneficiaries, DHS updated SAVE to show a technical Aug. 14, 2026 expiration but will issue a manual SAVE response because a federal court order and the Supreme Court ruling in Mullin v. Doe continue to preserve TPS status and work authorization.
- The agency rapidly revised and archived earlier guidance this week (including an Aug. 10 posting) to correct technical dates, underscoring that system timestamps in SAVE can differ from beneficiaries’ actual legal protections and that recipients should keep USCIS notices for proof and monitoring of further agency updates.
