U.S. Plans Abrego Garcia Removal to Liberia by Oct. 31

A Maryland judge has barred removal pending ongoing court cases.

Overview

  • Justice Department lawyers told a federal court that Liberia agreed to accept Kilmar Abrego Garcia and said DHS received diplomatic assurances on his treatment, with removal possible as soon as Oct. 31.
  • U.S. District Judge Paula Xinis has blocked his immediate removal, and Abrego Garcia remains in ICE custody in Pennsylvania as litigation continues.
  • Earlier efforts to send him to Uganda, Eswatini and Ghana fell through, and his attorneys say Costa Rica has offered to receive him as a refugee and pledged not to return him to El Salvador.
  • Abrego Garcia was wrongly deported to El Salvador in March despite a 2019 protection order, was returned to the U.S. in June, and has pleaded not guilty to human-smuggling charges in Tennessee.
  • A Tennessee judge found a realistic likelihood of vindictive prosecution and set a hearing for early November, as defense lawyers seek to question senior DOJ officials about charging decisions.
