U.S. Eases Syria Export Controls With New ‘Syria Peace and Prosperity’ Exception

Exporters gain pathways for civilian projects under intact bans on military support.

Overview

  • A BIS final rule effective September 2, 2025 revises EAR §746.9 for Syria and removes obsolete General Order No. 2.
  • License Exception SPP authorizes export and reexport of all EAR99 items to Syria subject to part 744 end-use and end-user controls, excluding SDNs, Entity List parties, and denied persons.
  • BIS extends the Consumer Communications Devices exception to Syria without NGO-only limits and broadens AVS, RPL, TMP, GOV, TSU, and BAG, while aircraft parts and national-security-controlled items remain restricted due to Country Group E:1.
  • Licensing now carries a presumption of approval for commercial or civil uses that support reconstruction in sectors such as telecom, water, power, and civil aviation, with other requests reviewed case by case.
  • Safeguards remain, including no authorization for support to military, police, or intelligence services and a 30-day congressional notification for exports that could significantly enhance military or terrorism capabilities.
