Two Quit Appeals Panel in Enoch Burke Case as High Court Sets Feb. 20 Date

Counsel said the departures open the door to a reconstituted panel that could render Burke’s injunction unnecessary.

Overview

  • Judge Brian Cregan granted a two-week adjournment to February 20 after the court was told of two resignations from the three-person appeals panel.
  • Padraic Lyons SC, for the panel members, said the resignations allow a new panel to be nominated and argued this may make Burke’s injunction application moot.
  • Appearing by videolink from prison, Enoch Burke called the appeals process a shambles, disputed that his injunction is moot, and sought time to consider the developments.
  • Asked about the remaining panel member, Lyons said nominations are outside his control, that renomination is possible, and that there is good reason to appoint three new members.
  • The dispute stems from a 2022 directive to use a student’s new name and pronoun; Burke has been fined €225,000 and jailed for more than 550 days for breaching court orders related to the case.
