Tom's of Maine Sets $2.9 Million Class Settlement Over Toothpaste

Eligible buyers can now file refund claims pending a September final approval.

Overview

  • A court‑authorized notice, published Monday, opened claims for anyone in the U.S. who bought Tom’s toothpaste from November 21, 2020 through March 6, 2026.
  • The proposed fund totals $2.9 million and will pay claims as well as notice, administration, attorneys’ fees, and service awards, with payouts reduced if claims exceed the fund.
  • Approved claims without receipts may receive the average sticker price for one product per household, while claims with receipts may get refunds for up to three products.
  • Colgate and Tom’s deny wrongdoing tied to alleged deceptive practices after a May 2024 FDA inspection flagged manufacturing compliance issues, and they say a review of about 4,900 finished toothpastes found no safety risk.
  • Claims are due by July 6, 2026 at ToothpasteSettlement.com, by phone at 1-877-315-6779, or by mail, and a final approval hearing is set for September 10, 2026 in federal court in New York.
