Tokyo District Court Rejects Ouin School’s Bid to Block 20-Story Tower Plan

The judge found no immediate harm since work cannot start until further approvals.

Overview

  • The Tokyo District Court, which ruled Monday, dismissed Ouin’s request to stop Tokyo from approving a high-rise next to the campus.
  • Presiding Judge Kenji Shinoda applied Supreme Court precedent that injunctions require a risk of serious damage, and said the permit by itself would not endanger students or staff.
  • The project would replace an existing eight-story building with a 20-floor tower about 69–76 meters tall, using a rule that relaxes a 46-meter cap if the site provides public open space accessible to anyone.
  • The school argued the tower would sit about 11 meters from classrooms, block sunlight, raise the risk of voyeuristic filming of girls, and threaten a shared retaining wall during construction.
  • The ruling leaves the metropolitan review process in place, and the school said it was very disappointed and may seek to cancel any approval later while it works to protect the learning environment.
