Swedish Court Rules Cargo Ship Caffa Can Be Surrendered to Ukraine

The decision creates a legal path for Ukraine to take custody of the vessel.

Overview

  • The district court ruled on June 5 that the seizure of the Caffa was lawful and that the ship may be handed over to Ukraine, subject to the owners’ right to appeal.
  • Swedish authorities detained the 96-metre cargo ship in the Baltic Sea in March after finding it sailed under a false flag and failed safety and seaworthiness checks.
  • Ukrainian prosecutors say the Caffa repeatedly entered ports in Russian-occupied Crimea, carried grain taken from those territories and unloaded cargo at third-country ports including Tartus in Syria.
  • Before any transfer can take place the ruling must become legally binding and the ship’s owners have about three weeks to lodge an appeal followed by Ukrainian judicial steps for final confiscation.
  • The case exposes common concealment tactics such as false registration listed as 'Guinea False', has led to criminal charges for one crew member, and could set an international precedent for using legal assistance to pursue vessels tied to alleged wartime appropriation.
