Supreme Court Upholds Law Narrowing Jamanxim Park to Enable Ferrogrão

Overview

• The Supreme Federal Court formed a majority to validate Lei 13.452/2017 on May 21, 2026, rejecting PSOL’s challenge and leaving the statutory reduction of the park in place.
• The decision does not authorize works, because entrepreneurs must still secure environmental licenses and other permits before any construction can start.
• Minister Edson Fachin was the lone dissenter and Minister Cármen Lúcia did not participate, while Minister Flávio Dino voted to validate the law subject to specific safeguards.
• The law removed about 862 hectares from Parque Nacional do Jamanxim, a change that originated in MP 758/2016 and was the target of the procedural challenge over use of a measure provisória.
• The Transport Ministry said it will wait for the Tribunal de Contas da União to appraise the concession and will continue technical studies and financing work with BNDES before publishing a tender for the roughly 933 km Ferrogrão line.
