Supreme Court Grants Conditional Bail to DHFL’s Wadhawan Brothers in CBI Bank-Fraud Case

The bench cited the constitutional right to a speedy trial as the case’s vast record makes early completion unrealistic.

Overview

  • Justices J. K. Maheshwari and Vijay Bishnoi allowed the brothers’ appeals and set aside Delhi High Court orders from August and September 2025 that had denied regular bail.
  • The release terms include a personal bond of Rs 10 lakh each with two sureties, surrender of passports, no overseas travel without prior permission, monthly police reporting, and no contact with witnesses.
  • The Court noted that charges are yet to be framed and that a voluminous record—over four lakh pages, 736 witnesses, 17 trunks of documents, and large digital data—means even daily hearings would not conclude the trial in two to three years.
  • The order records that Kapil and Dheeraj Wadhawan have been in custody since April 2020 and had secured bail in other related matters, with the investigation in this case stated to be complete.
  • CBI alleges about Rs 34,600–34,900 crore was siphoned from loans raised from a 17-bank consortium led by Union Bank of India through shell entities, invoking IPC sections 120B, 409, 420, 477A and the Prevention of Corruption Act, with the Supreme Court not commenting on the merits.
