Supreme Court Dismisses PIL on Netaji, Bars Repeat Filings by Petitioner

The order signals a firm move to keep public interest cases from being used to settle disputed history.

  • The Supreme Court of India dismissed on Monday a public interest case by Pinakpani Mohanty that asked it to credit Subhas Chandra Bose’s Indian National Army with winning independence.
  • Chief Justice Surya Kant and Justice Joymalya Bagchi rebuked him in open court, with the CJI warning, “We will ban your entry into the Supreme Court.”
  • Citing his repeat filings, the Bench ordered the Registry not to accept any future public-interest writs from him after a similar plea was thrown out in 2024.
  • The petition also sought to label Bose the “National Son,” declare October 21 and January 23 as national days, declassify records from 1946–47, and name his Cuttack birthplace a national museum.
  • The judges said courts cannot decide contested historical facts and noted that any lawful claim should be pursued by Bose’s daughter, Anita Bose Pfaff, identified as his sole legal heir.
