Supreme Court Defers ED Plea on Alleged Mamata Banerjee Interference to Feb. 18

The case tests the limits of state authority over central probes.

Overview

  • A bench of Justices Prashant Kumar Mishra and Sandeep Mehta postponed the hearing after being informed that senior advocate Kapil Sibal was unwell.
  • The Enforcement Directorate seeks Supreme Court directions for FIRs against Chief Minister Mamata Banerjee, the state DGP and the Kolkata Police Commissioner, as well as a CBI probe into alleged obstruction during January 8 searches.
  • The searches targeted I-PAC’s Kolkata office and co-founder Pratik Jain’s residence in a money-laundering probe linked to an alleged coal-pilferage scam.
  • On January 15, the Court stayed West Bengal Police FIRs against ED officials and ordered preservation of CCTV footage and other digital recordings from the premises.
  • In a counter affidavit, Banerjee denies interference, says she retrieved proprietary Trinamool Congress data with officials’ assent, and questions the timing and purpose of the ED operation.
