Suffolk Grand Jury Adds 81 Counts Against Ex-Brigham Doctor Accused of Sexual Assault

The case tests a strategy to prove exams exceeded consent under rules that predate a 2024 law.

Overview

  • Prosecutors said a Suffolk County grand jury on Tuesday returned 81 counts that include 21 rape charges, one assault with intent to rape, and 59 indecent assault and battery.
  • The new indictment covers alleged assaults from 2017 to 2023 at Brigham and Women’s Hale Building in Boston and the Faulkner Hospital in Jamaica Plain involving 22 women ages 17 to 56, and prosecutors say many were desperate for relief from serious symptoms.
  • The filing pushes Todd’s total exposure across Suffolk and Middlesex counties to more than 100 charges, and a Suffolk Superior Court arraignment is pending as his lawyers say they have not received details of the new counts.
  • Because most alleged conduct predates the 2024 change to Massachusetts consent law, prosecutors say they will argue the doctor went beyond any consent the patients gave during pelvic and breast exams.
  • More than 270 former patients have filed civil suits, and Mass General Brigham says it reported Todd to law enforcement after internal complaints during its review.
