- Administrative judges in Stuttgart denied all emergency motions from the FDP and found no entitlement to join the SWR TV debate.
- The court upheld SWR’s concept under the principle of abgestufte Chancengleichheit, which weighs current polling and recent election results.
- It cited surveys showing CDU, Greens and AfD each with a realistic chance above 20 percent, versus the FDP near five percent and 0.8–5.2 percent in recent contests.
- The decision is not yet final, and the FDP says it will complain to the higher administrative court; judges also rejected bids to bar the AfD or to cancel or reschedule the program.
- SWR will air the triell on 24 February with Manuel Hagel, Cem Özdemir and Markus Frohnmaier, and plans a 26 February Wahlarena expected to include the FDP.
