STF Orders Government and Congress to Draw Up Emendas Responsibility Matrix

The court move seeks to decide whether deputies and senators who pick beneficiaries must bear the same accounting duties as public spending authorizers.

Overview

  • On Wednesday, July 29, STF minister Flávio Dino gave President Luiz Inácio Lula da Silva and the presidents of the Chamber and Senate ten days to deliver a detailed 'matrix of responsibilities' mapping who does what across the emenda lifecycle.
  • Dino also required the Advocacia‑Geral da União and the Procuradoria‑Geral da República to file opinions within five days and set a fast track that can send the case directly to the Court's Plenary.
  • The order stops short of immediately treating parliamentarians as spending authorizers or imposing penalties but specifically asks the plan to explain how an MP who names a beneficiary could be held to account.
  • The demand responds to CGU and TCU audits and Police Federal probes that flagged lack of traceability, diversion of purpose, stalled infrastructure works and questionable contracts as emenda spending jumped from R$11.3 billion in 2014 to about R$47.1 billion in 2025.
  • A Plenary ruling that widens MPs' duties could change how nearly R$50 billion in yearly parliamentary allocations are run by imposing new reporting, procurement and legal liabilities and by clarifying which institutions investigate and punish misuse.
