Spanish Social Security Makes Electronic Notices the Default for Sick Leave and Related Benefits

Shifting legal effect to the Social Security’s Sede Electrónica is meant to speed up decisions; the rule keeps exceptions and in-person help to protect people who lack digital access.

  • The new ministerial order published in the BOE takes effect on 1 September and will make electronic notification the normal channel for people in procedures on sick leave, permanent incapacity and certain birth‑and‑care or pregnancy‑related benefits.
  • The regulation places legal effect on documents made available in the Social Security Sede Electrónica while allowing email or SMS alerts only as informational prompts with links to the portal.
  • Recipients must use a recognised digital ID (certificado electrónico, Cl@ve PIN or DNIe) to access notices and a notification will be treated as rejected if not opened within ten calendar days after it is posted.
  • The order preserves explicit exceptions to paperless rules and requires in-person assistance at Centros de Atención e Información de la Seguridad Social so the Administration can help people who cannot use digital channels.
  • The change extends a long-running digitalisation drive under Law 39/2015 and earlier Social Security rules and is intended to speed processes and cut costs, but it raises practical risks for users who do not check the Sede Electrónica or lack digital ID.
