Spain’s Judicial Council Grants Protection to Judge in Juana Rivas Case

The ruling draws a clear line between judicial protection from pressure and permissible political speech.

Overview

  • The General Council of the Judiciary, which ruled Wednesday, unanimously granted institutional amparo to Judge Aurora María Angulo.
  • The Council said a press note by Rivas’s then-lawyer, Carlos Aránguez, was an objectively disturbing campaign of discredit that placed extra-procedural pressure on the judge, and it ordered public diffusion of its decision as a remedy.
  • It excluded statements by the equality and childhood ministers, finding their comments respectful of the judicial role and within normal political activity.
  • Angulo had declined competence last year after classifying the alleged conduct as domestic mistreatment rather than gender-based violence, which led the lawyer to accuse her of not understanding so‑called vicarious violence and of shelving a complaint.
  • Coverage also recalls that a civil court in Cagliari ordered the younger child’s return to Italy and the child did return, and some reports described the lawyer’s earlier press note as an attempt to pressure the magistrate.
