Spain’s Audit Court Orders Ex-Catalan Anti-Fraud Chief to Repay €82,341 for Improper Pay

Prescription of earlier payments kept the repayment far below what OAC and prosecutors sought.

Overview

  • The Tribunal de Cuentas calculated the harm at €138,240.88 but ruled amounts paid before 27 March 2013 were time-barred.
  • It assigns Daniel de Alfonso €71,363 for his own overpayments and €10,978.27 for trienios improperly paid to two senior OAC officials.
  • The ruling labels his conduct serious negligence for authorizing seniority increments from prior judicial service under the OAC’s more favorable formula.
  • Payments from 2015 to 2016 were treated as supported by a Parlament resolution, which limited the recoverable sum.
  • The OAC and the public prosecutor had pursued more than €205,000, and the decision is appealable to the Tribunal de Cuentas’ Justice Chamber.
