- The 4th Public Treasury Court granted an injunction on Feb. 9 suspending collection of the R$500,000 penalty issued after Uber offered motorcycle rides in January 2025.
- Judge Antônio Augusto Galvão de França ruled the fine could not stand because it was based on a municipal decree the São Paulo appeals court found unconstitutional in September 2025.
- After that ruling, the city issued regulations in December 2025, but in January 2026 STF minister Alexandre de Moraes suspended provisions on red plates and mototaxi equivalence and set a 60‑day window to review accreditation requests.
- The São Paulo administration said it had not been formally notified of the injunction and would evaluate potential appeals.
- Despite favorable court decisions, Uber and 99 have not restarted motorcycle passenger services in São Paulo.
