SEC Seeks Court OK to Email Summons to Gautam and Sagar Adani After India Rejects Hague Service

A judge’s decision on alternative service will determine whether the SEC’s civil case can move forward.

Overview

  • The motion filed Jan. 21 in the Eastern District of New York asks Judge Nicholas Garaufis to permit service through the Adanis’ U.S. counsel and to their business email addresses.
  • India’s Law Ministry twice declined Hague Convention requests in 2025, citing missing ink signatures and official seals and questioning the SEC’s authority to seek service.
  • Adani group shares fell between 3.4% and 14.6% on Friday, wiping out roughly $12.5 billion in market value, with Adani Green down nearly 14% and Adani Enterprises off about 11%.
  • Adani Group called the allegations baseless, and exchange filings from Adani Enterprises and Adani Green said the companies are not parties to the U.S. proceedings.
  • The SEC civil case is separate from a DOJ criminal indictment unsealed in November 2024 that remains pending, and the court has not yet ruled on the SEC’s service request.
