Overview
- The crash at Three Trees, Quigley’s Point on 20 August 2020 saw a family car leave the road and enter Lough Foyle, killing John Mullan, 49, and his children Tomás, 14, and Amelia, 6 while Geraldine Mullan survived.
- Whitemountain Quarries Limited, part of the Breedon Group, pleaded guilty at Letterkenny Circuit Criminal Court and was fined €1.2 million by Judge Roderick Maguire on 31 July 2026.
- Court evidence said the car’s front passenger wheel slipped onto an unfinished hard shoulder five to six centimetres below the resurfaced carriageway, with poor grip, no central road markings and no cones visible on part of the northbound lane.
- The court was told a subcontracted traffic-management firm had been stood down earlier that day, the contractor put up its own cones and signage, and Breedon’s CEO apologised in court and accepted responsibility.
- Breedon and Whitemountain told the court they cooperated with the Health and Safety Authority, have tightened safety controls including director approval before standing down traffic subcontractors, and the victim said the judgment brought some measure of accountability but not an end to her grief.
