Real-World EV Range Improves as German Ruling Raises Risk for Makers

Summer El Prix results showed many models matching lab WLTP figures, creating commercial pressure after a Wuppertal court ruled large range shortfalls can justify buybacks and refunds.

  • The test showed clear model-by-model variance against WLTP: Xpeng exceeded its claim by about 11 percent while the MG IM6 fell roughly 11.7 percent short, illustrating how battery size, efficiency and ageing change real range.
  • The Landgericht Wuppertal decision (case 10 O 282/23) ruled that an expert-measured range of 282 km versus an advertised 332–341 km was a substantial defect and ordered the dealer to take back the car and reimburse the buyer after usage deductions.
  • The court applied a familiar >10 percent tolerance from combustion-engine case law, relied on lab-standardized WLTP comparison and expert analysis of accelerated battery degradation to reach its verdict.
