Overview
- The state could notify riot-hit or communally sensitive localities as disturbed areas for up to three years to regulate transactions and protect tenants.
- No sale, purchase, transfer or registration of property in a notified zone would be allowed without prior written approval from the District Collector or Additional District Magistrate.
- Breaches would draw 3–5 years’ imprisonment and a minimum fine of Rs 1 lakh or 10% of the property’s fair value, with offences classified as cognizable and non-bailable.
- The proposal defines “improper clustering” as coercion- or distress-driven concentration of one community and gives the law retrospective effect with six-month refund and property-return requirements after voided transfers.
