Rajasthan Police Issue SOP Barring Release of Arrestees’ Photos After HC Rebuke

The statewide SOP follows a High Court order that denounced public shaming of arrestees as a breach of Article 21.

Overview

  • Police headquarters directed all units not to post or share images or videos of arrested persons and to ensure respectful treatment in custody, with added sensitivity for women and other vulnerable groups.
  • Justice Farjand Ali of the Rajasthan High Court condemned the practice of parading arrestees and circulating their photos as "institutional humiliation" and a direct assault on human dignity.
  • The court ordered removal within 24 hours of specified images, including those of a Jodhpur advocate, and said such acts lack any basis in the CrPC, the Bharatiya Nagarik Suraksha Sanhita, or the Police Act.
  • The Jaisalmer SP and the Jodhpur Police Commissioner must file affidavits detailing compliance and safeguards, while the state was asked to respond through the Additional Advocate General.
  • Petitioners alleged routine photographing at station entrances and, in some cases, forced stripping, with the court warning of lasting reputational harm and listing the matter for January 28.
