Punjab and Haryana HC Rejects GMADA Affidavit, Fines Rs 25,000 Over Incomplete Record

The bench demanded a comprehensive, itemized affidavit with full enforcement particulars for each alleged violator.

Overview

  • A division bench of Chief Justice Sheel Nagu and Justice Sanjiv Berry called GMADA’s filing non-speaking and lacking dates of notices, violation details and action taken.
  • The court ordered Rs 25,000 in interim costs to be deposited in the Poor Patients Welfare Fund of PGI Chandigarh.
  • GMADA was directed to file a fresh affidavit detailing, for each alleged defaulter, the notices issued, the nature of violations, steps taken, the current status of proceedings and any interim protection in appeals.
  • Official tallies have conflicted, with GMADA initially citing 28 violators in Siswan against the Forest Department’s 182 districtwide before GMADA’s later survey identified 193 unauthorised constructions.
  • GMADA said action has been initiated under the 1995 planning law and the 1952 periphery control law and that a districtwide survey would conclude by March 31, as the court also questioned its reliance on separate contempt proceedings and listed the case for next week.
