Public Hearing Into Myles Gray’s 2015 Death Opens as VPD Officers Deny Misconduct

The 10-week OPCC proceeding led by retired justice Elizabeth Arnold-Bailey aims to resolve questions left by conflicting probes, including a no-misconduct discipline ruling.

Overview

  • Margie Gray testified on day one, describing her 911 call and identifying her son by mud-caked necklaces after learning he died following an encounter with police.
  • All seven named VPD constables denied allegations of abuse of authority and neglect of duty; two were absent for medical reasons and none can be compelled to testify.
  • On day two, a civilian witness said Gray “didn’t look right” as he paced and mumbled before police arrived, and another 911 caller reported being sprayed with a hose.
  • The hearing at UBC Robson Square is scheduled for about 10 weeks with more than 30 witnesses, including emergency responders, a use-of-force expert and Vancouver Police Union representatives.
  • The OPCC ordered the hearing after divergent outcomes across prior reviews: the IIO found grounds to believe offences may have occurred, prosecutors declined charges in 2020, a 2023 inquest returned a neutral homicide verdict, and a 2024 discipline authority cleared the officers.
