Prosecutors Drop Bid to Revoke Bail After Low Positive Breath Test in Tim Picton Case

They concluded a 0.014 reading did not prove alcohol consumption following review of defence video evidence alongside a scientific journal.

Overview

  • Dewar, 20, remains on bail under 12 conditions including an alcohol ban, a 7pm–5am curfew, residence at his parents’ home, surrender of his passport and random testing.
  • Police recorded a 0.014 reading during a curfew check early Sunday, but the prosecutor told the court the state could not prove he had consumed alcohol in breach of bail.
  • The revocation bid was abandoned after the defence provided a video and scientific material, and the prosecutor indicated procedures may change to avoid similar enforcement issues.
  • Dewar is charged with manslaughter over a December 27 incident outside a Northbridge nightclub that preceded Tim Picton’s death, and he also faces a separate December 25 assault charge in Kalamunda.
  • He has not entered pleas and is due back in court on April 29, with reporting indicating prosecutors are expected to drop the grievous bodily harm charge linked to Picton.
