Prosecutor Agrees to Dismiss Misdemeanor Drug Charges Against Bode Miller

The prosecutor says new information undercuts the probable-cause account that led to the June arrest.

Overview

  • Court records show Miller was stopped and arrested in Fremont County, Idaho, on June 6 and charged with two misdemeanors: possession of a controlled substance and possession of drug paraphernalia.
  • A probable-cause affidavit by a sheriff’s deputy alleged a white dispensary bag containing about 4.1 grams of psilocybin mushrooms was found, while Miller posted an Instagram statement saying a friend in the vehicle had a small amount of cannabis that he did not know about.
  • Miller posted a $5,000 cash bond, was released, and entered not guilty pleas to both charges in mid-June, with a pretrial hearing currently on the docket for July 29.
  • Miller’s attorney said Fremont County Prosecuting Attorney Lindsey Blake agreed to dismiss the misdemeanor counts after receiving additional information; Blake has confirmed the office will dismiss but has declined to disclose specifics because they relate to another active case.
  • Under Idaho law psilocybin is a Schedule I drug and possession carries up to one year in jail and a fine; the apparent dismissal ends the immediate criminal exposure for Miller but leaves questions about conflicting accounts and the evidence that prompted the prosecutor’s change.
