Profeco Clarifies It Has No Power to Fine Tortilla Sales From Coolers or Motorcycles

Profeco says sanitary enforcement belongs to health authorities, not the consumer agency.

Overview

  • An Odeco Gulf-North director in Tampico had said fines could reach 4 million pesos and that at least four businesses faced actions for selling tortillas from coolers or by motorcycle.
  • Profeco issued an official correction stating it cannot sanction hygiene, sanitary or food‑handling conditions anywhere in the country.
  • The agency reiterated its limited role under the Maize–Tortilla agreement, including price monitoring in 600+ tortillerías, visible pricing and calibration of scales.
  • Reports cited NOM‑187 for sanitary requirements in masa and tortilla production and transport and NOM‑051 for labeling, with health authorities responsible for related inspections and penalties.
  • Small‑retailer group ANPEC warned that curbing cooler or motorcycle distribution could push tortilla prices higher, as regional monitoring efforts continue under proper jurisdiction.
