Pirro Drops Appeal Plan, Will Seek to Vacate Judge's Order in Powell Probe

The shift puts the Fed inspector general's findings in position to decide if the case returns.

Overview

  • U.S. Attorney Jeanine Pirro, who said Sunday on CNN she was changing course, will ask the court to vacate Judge James Boasberg's order instead of filing the appeal she had planned.
  • She urged Federal Reserve inspector general Michael Horowitz to finish his separate review and said she could restart the criminal case if his report shows evidence of a crime.
  • Federal prosecutors closed the Powell inquiry in late April and shifted fact-finding to the inspector general after Boasberg's ruling cut off subpoenas for Federal Reserve records.
  • Boasberg in March quashed subpoenas to the Fed, writing that they appeared designed to pressure Chair Jerome Powell to lower interest rates or resign.
  • Powell said he will stay on the Fed Board after his chair term ends until the legal threats are resolved, citing concern for the central bank's independence following political attacks over a renovation probe that a 2021 audit found showed no wrongdoing.
