Peru’s Constitutional Court Sets Feb. 17 Hearing on JNE–Judiciary Clash Over Party Registration

The case will test whether electoral decisions on party registration are shielded from judicial review before the 2026 elections.

Overview

  • The court will hear the JNE’s competence lawsuit sparked by a judicial order that sought the registration of Unidad Popular in the party registry.
  • The session is set for Tuesday at 9:15 a.m. at the TC’s San Isidro headquarters, with representatives of the Judiciary and Unidad Popular’s legal agent Duberlí Rodríguez expected to attend.
  • The JNE asks the TC to affirm that, under Article 178(2)–(4) of the Constitution, administering the registry and enforcing party rules are exclusive electoral functions.
  • Earlier judicial actions included fines on JNE plenary members and the registry chief for not complying with orders to register the party, and a 20‑URP penalty—about S/10,000—on the JNE’s procurator in November 2025.
  • A decision is expected in the days after the hearing and could define the boundary between electoral authorities and ordinary courts for the 2026 process.
