Overview
- The Executive published the decree on Friday, creating an exceptional, time-limited procedure that allows the Comisión de Gracias Presidenciales to review commutation requests for convictions for omission of child support.
- To be eligible an inmate must be in the closed ordinary regime, have no more than one effective conviction, have no pending criminal proceedings, and have paid at least 70% of the judicially determined child support debt.
- The rule does not grant automatic release because each file must be verified case by case by the Commission and any commutation can be conditioned or revoked if obligations are not met.
- The National Prison Institute (INPE) estimates roughly 2,691 inmates could be eligible and the decree allows consideration of payments or applications made before its publication; the measure runs until December 31, 2028.
