Paraná Prosecutors Say Hiker Was Intentionally Abandoned, Seek Penal Agreement

Prosecutors propose a non-trial deal requiring payments to the hiker, with community service at the fire department.

Overview

  • Following a technical review, the MP-PR concluded Thayane Smith committed omission of aid with intent by leaving 19-year-old Roberto Farias Thomaz despite signs he was at risk.
  • The Promotoria asked to send the case to the Special Criminal Court and proposed a penal transaction: R$4,863 to Roberto, R$8,105 to the Campina Grande do Sul Fire Department, and three months of weekly community service there.
  • The prosecutorial finding conflicts with the Paraná Civil Police, which had archived the inquiry after saying no crime occurred or aid was withheld.
  • Roberto disappeared on January 1 and reached a farm in Antonina on January 5 after walking about 20 kilometers along the Cacatu River, where he borrowed a phone to call his sister.
  • Thayane’s Paraná-based lawyer said she left the case on January 9, while her defense team in Amazonas reported it had not yet accessed the case files; the episode continues to draw national attention, including reported advertising appearances by Roberto.
