NYC Orders Uber Eats, Fantuan and HungryPanda to Repay Millions, Restore Deactivated Workers

The agreements follow a DCWP investigation that found widespread underpayment during canceled orders.

Overview

  • Uber Eats will pay $3.15 million in restitution to more than 48,000 couriers and $350,000 in civil penalties, according to city officials.
  • Uber agreed to reinstate up to 10,000 workers deactivated between December 2023 and September 2024 after automated rules flagged cancellations.
  • DCWP said nearly 50,000 workers across Uber Eats, Fantuan and HungryPanda were shorted pay that is required once a delivery is underway even if a customer cancels.
  • Officials signaled ongoing enforcement, including a recent suit targeting Motoclick, as Uber said it corrected issues after the agency’s August 2024 notice.
  • New city rules that took effect January 26 require a tipping option at checkout with a 10% choice and expand the minimum‑pay floor for app‑based couriers.
