NIA Court Orders Attachment of Fai’s Land in Budgam as Police Begin Enforcement

The order follows his proclaimed‑offender status in a 2020 UAPA case and uses Section 83 of the CrPC to authorize immediate seizure.

Overview

  • Special Judge Yahaya Firdous directed attachment of two plots owned by Ghulam Nabi Fai—1 kanal 2 marlas in Wadwan (Khewat 60, Survey 466) and 11 marlas in Chattabugh (Khewat 136, Survey 343)—with possession to be taken forthwith.
  • Assistant Public Prosecutor Mohammad Iqbal Rather sought the action under Section 83 CrPC (Section 85 BNSS) after the court had declared Fai a proclaimed offender in 2025 for failing to appear in FIR No. 46/2020.
  • The District Collector was told to identify and demarcate the land and take possession with support from the Budgam SSP, and police publicly posted attachment notices at the sites.
  • The underlying case, registered at Budgam Police Station under Sections 10, 13 and 39 of the UAPA, remains active while Fai resides in the United States and has not joined the investigation.
  • Fai, a US citizen and founder of the Kashmir American Council, previously pleaded guilty in the US to conspiracy and tax offenses tied to undisclosed Pakistan/ISI funding for lobbying and served a prison term.
