New York Requires Labels for AI-Generated Ads and News

Labels for AI-created performers and AI-produced news aim to preserve trust in reporting, protect media workers, impose civil fines for violations.

Overview

  • A law that makes advertisers label AI-generated “synthetic performers” went into effect on Tuesday after Gov. Kathy Hochul signed it in December, and it requires conspicuous disclosure for any ad using a digitally created person.
  • The state legislature passed the NY FAIR News Act and sent it to Gov. Hochul for review, requiring news outlets to disclose content that is substantially or wholly produced by AI and to block AI access to journalists’ confidential sources and materials.
  • Both the advertising rule and the proposed news law set civil penalties of $1,000 for a first violation and $5,000 for subsequent violations, creating new enforcement tools for regulators and legal risk for noncompliant publishers and advertisers.
  • Unions and labor groups including SAG‑AFTRA, the Writers Guilds and the NewsGuild backed the measures as protections for reporters and performers, while advertising trade groups warned the rules create compliance uncertainty for brands and agencies.
  • The laws deepen state-level AI oversight in a way that may clash with a federal push for limited state regulation, and open questions about scope, carve-outs for entertainment work and third‑party ad creators could shape upcoming legal and industry guidance.
