New Jersey Requires Takeout Utensils Only When Customers Ask

The move aims to cut plastic waste, lower restaurant costs, with enforcement rules still to be finalized by state regulators.

Overview

  • The law, which took effect Saturday, Aug. 1, 2026, bars restaurants and delivery apps from automatically including single-use items such as plastic forks, straws, napkins and condiment packets unless a customer requests them.
  • Online and third-party delivery orders must default to no utensils or condiments, requiring customers to opt in or check a box to receive those items when they place orders.
  • Full-service restaurants above a size threshold must provide reusable, washable utensils for dine-in customers while some venues and settings have limited exemptions.
  • State officials will issue warnings for first offenses and can levy fines for repeat violations, but agencies have not yet published clear enforcement procedures or a firm fine schedule.
  • Supporters call the law a statewide standard that builds on more than 60 local ordinances and similar rules in other jurisdictions, and restaurants say it should cut costs even as employees and customers adjust to the new routine.
