National Board of Justice Confirms Dismissal of Delia Espinoza as Supreme Prosecutor

Only an amparo before Peru’s judiciary now remains for Espinoza.

Overview

  • On March 16, the JNJ rejected Espinoza’s appeal and upheld her January removal in disciplinary case No. 061-2025-JNJ.
  • The board said she committed very serious misconduct by disregarding its June 2025 order to reinstate Patricia Benavides, citing accounts of a June 16 standoff at the prosecutor’s headquarters.
  • With the administrative route exhausted, Espinoza can attempt to challenge the sanction through a constitutional amparo in the courts.
  • Responding to the ruling, Espinoza urged the Constitutional Court to take up what she describes as a jurisdictional dispute and to promptly schedule a public hearing.
  • Over the weekend, Espinoza was elected dean of the Lima Bar Association, defeating attorney Humberto Abanto.
