Moraes to Review PSOL Challenge to Rio Bonus for ‘Neutralizing’ Suspects

Justice Alexandre de Moraes now reviews a request for an emergency suspension during the court recess.

Overview

  • PSOL filed a case at the Supreme Federal Court against Rio’s Law 11.003/2025, targeting Article 21 that offers a 10% to 150% salary bonus for outcomes including the ‘neutralization of criminals’ and seizure of restricted-use weapons.
  • The party argues the rule is unconstitutional on its merits and also suffers a procedural flaw because the legislature added the bonus to an executive bill that did not originally address pay.
  • Governor Cláudio Castro vetoed the article over budget concerns, but the state assembly overturned the veto in December, leaving the provision currently in force.
  • The case was assigned to Moraes by prevention due to its connection with the ADPF das Favelas, and he can issue a provisional suspension subject to later review by the full court.
  • Rights institutions such as the DPU say the measure encourages lethal confrontations and point to a 1995 ‘gratificação faroeste’ that studies linked to summary executions.
