Moraes Orders PGR Reply on Mauro Cid’s Bid to Extinguish Sentence

The request will force the federal prosecutor to re-examine whether long-term restrictive measures should count as time served and thus decide if Cid’s two-year sentence ends.

  • Cid’s lawyers ask the court to extinguish his two-year prison term by crediting more than two years and five months that he says he spent under restrictive measures like electronic monitoring, nightly home confinement, travel limits and weekly court check-ins.
  • The legal question centers on detração, which asks whether measures other than preventive detention can be deducted from a sentence, and it will determine if those restrictions amount to time served.
  • The PGR previously argued against counting such measures, and after that earlier filing Moraes began Cid’s sentence in November 2025 with continued restrictions while allowing removal of the ankle monitor.
  • After the PGR files its renewed view the case will return to Moraes for a ruling and the decision could change how Brazilian courts treat precautionary measures for cooperating defendants and other accused people.
