Minnesota Charges ICE Agent With Assault Over Alleged Gun Threat on Highway

The case signals a test of state authority to prosecute federal officers for conduct outside their lawful duties.

Overview

  • Hennepin County prosecutors, who filed the charges Thursday, obtained a nationwide arrest warrant, and officials said Saturday the agent had not been taken into custody.
  • Prosecutors say Gregory Donnell Morgan Jr. drove an unmarked rental SUV on the shoulder of Highway 62 on Feb. 5, pulled alongside another car, and pointed his duty weapon at the driver and a passenger who later told 911 they feared for their safety.
  • Investigators traced a Utah rental plate to ICE, interviewed Morgan the next day, and reviewed video that matched the victims’ account, and charging papers note he yelled “Police, stop” even though the victims could not hear him through closed windows.
  • Moriarty said this is the first criminal case tied to Operation Metro Surge, a federal deployment that sent about 3,000 immigration agents to the Twin Cities and drew mass protests after two U.S. citizens, Renée Good and Alex Pretti, were shot and killed in January.
  • State officials are still reviewing at least 17 other use-of-force incidents and have sued for federal evidence, while DOJ’s acting leader has warned of possible action against local officials who arrest federal agents, a clash that could push this case into federal court.
