Middlesbrough Driver Jailed for 58 Months Over Fatal Overtake That Killed Moped Rider

The judge called the split-second decision an avoidable tragedy, citing evidence he overtook without a clear view at about 40mph.

Overview

  • Mustafaa Hussain, 27, was sentenced at Teesside Crown Court to four years and ten months in custody, a seven-year-five-month driving ban, and an extended retest requirement.
  • The collision happened on November 23, 2023 on Riverside Park Road when he pulled out to pass a stationary vehicle into the path of oncoming rider Mark Coleman with visibility obstructed by traffic and a highway maintenance truck.
  • Forensic analysis showed he accelerated from about 32 to 42mph five seconds before impact and, a second before the crash, braked and veered left while still traveling around 40mph.
  • Coleman died three days later at James Cook University Hospital, with the cause of death recorded as blunt force head trauma.
  • After initially denying the charge, Hussain changed his plea to guilty on December 18, and the court heard emotional statements from Coleman's partner and parents describing their family as destroyed by the loss.
