Mexico Activates 40-Hour Week Transition, Raising Questions for Special Shifts

Employers have seven months to prepare before the first cut to 46 hours on January 1st, 2027.

Overview

  • The reform, which took effect Friday with publication in the federal gazette, gives employers about 210 days to adjust before the workweek steps down to 46 hours on January 1st, 2027.
  • Pay and benefits cannot be cut as hours fall, which forces redesigns that many firms have yet to start, with EY reporting only 27% in early preparation.
  • Overtime limits will rise in stages to a 12-hour weekly cap by 2030, with ordinary extra hours paid at double, exceptional cases at triple, and no more than four extra hours in a day.
  • Electronic timekeeping becomes mandatory from 2027, the Labor Ministry can review those records, and fines for violations range from 29,327 to 586,550 pesos.
  • Labor lawyers warn that 4x3, 12x12, and 24x24 shift patterns now sit in a legal gray zone after changes to the law, and courts may need to set criteria under a hard 12-hour daily ceiling.
