Mexicali Mother Faces Homicide-by-Omission Charge in Heat Death of 3-Year-Old

Prosecutors seek to treat her inaction as intentional risk, which carries a far tougher penalty than negligence.

Overview

  • The boy, identified as Vicente, was found unresponsive after more than 12 hours strapped in a rear car seat in a parked vehicle in Mexicali.
  • Forensic officials said he died of hyperthermia and noted first-degree burns on his thighs and forearms consistent with heat inside the car.
  • The medical examiner estimated outside temperatures at 25–35°C while the vehicle’s interior likely rose to about 45°C, which can be fatal for a child.
  • The mother, Roxana “N”, is jailed as prosecutors pursue homicide by omission with dolo eventual, a theory that she accepted a deadly risk and that could mean up to 15 years in prison.
  • At an initial hearing, prosecutors described a night of drinking and social media posts before the child was found near midday, while authorities also confirmed no signs of physical violence and released the body to the father.
