Man Charged With Homicide After San Jose Crash That Followed Police Chase

Prosecutors say the charges aim to hold the fleeing driver criminally responsible for a passenger’s death.

Overview

  • A high-speed pursuit that began after Santa Clara officers saw a gold Buick driving erratically ended in a crash in San Jose on Sunday, June 14, when the Buick ran a red light at Naglee and Park avenues and hit another car and a traffic pole.
  • The Santa Clara County District Attorney filed homicide and multiple related counts on June 19 against 38-year-old Justin Buban, including evading an officer causing serious injury or death, reckless driving, and driving under the influence causing bodily injury.
  • Police say Buban was hospitalized with serious injuries and remains in custody and that he had multiple outstanding arrest warrants at the time of the chase for charges such as alleged felon in possession and taking a vehicle without consent.
  • The Buick’s adult passenger was pronounced dead at the scene and the Santa Clara County Office of the Medical Examiner has not yet released the victim’s identity while investigators continue their traffic probe.
  • San Jose police have asked anyone with information to contact their Traffic Investigations Unit at (408) 277-4654 and the charging marks the next step in a prosecution that could clarify legal accountability and public-safety responses to high-speed chases.
