Overview
- The Madras High Court, which ruled on Monday, threw out the prosecution against filmmaker Gautham Vasudev Menon tied to Photon Kathas’ alleged non-filing of returns.
- The judge accepted Form 32 filed with the Registrar of Companies showing Menon resigned as a director on May 2, 2011.
- That timing placed him outside the relevant period, since assessment year 2013–14 covers the 2012–13 financial year.
- The relief applies only to Menon, and the case will continue against S. Venkatramanan, T. S. T. Ramanujam, Reshma Ghatala, and Photon Kathas Production Private Limited.
- The court directed the Egmore economic offences court to finish the remaining trial within three months under Section 276C, which addresses wilful tax evasion by companies and the officers in charge during the period.
